Webinar: Screening foreign investment – the rising importance of economic security
ADS is pleased to host a free-to-participate webinar for ADS members only on the National Security and Investment Act, and its place within the global context of governments around the World who are trying to control investment.
The National Security and Investment Act (NSIA) 2021 came into force on Tuesday 4 January 2022 and sought to create a strengthened national security regime for screening proposed investment. The regime has strengthened the UK Government’s powers to investigate and intervene in potentially hostile investment, especially in critical sectors such as defence and space, whilst also, simultaneously, seeking to ensure that the UK maintains its reputation as an attractive place to invest.
It had particular implications for ADS’ four sectors (all of whom are listed as being strategically important) and so ADS organised two awareness-raising webinars on the NSIA – one (with Baker McKenzie) on Tuesday 24 November 2020, and the second (with BEIS and Squire Patton Boggs) on Tuesday 16 November 2021. The second annual report on the NSIA’s implementation was recently published, and ADS’ assessment of it is to be found here.
This third webinar is intended to assess how the implementation of the UK’s NSIA has bedded down and to learn lessons have been able to be identified, and also to compare the NSIA to the US’ CFIUS system, as well as wider global developments of a similar nature.
